Unless otherwise posted at the deviation , the following are the guidelines for use of our stocks, resources, textures, and possibly other materials... This includes all forms of 'use', including direct [i.e. - photo manipulation] and indirect [i.e. - reference for other art] , but are not limited to...

Credit must be given : This means a comment & link posted at our deviation(s) that you have used (whether it is actual use, partial use or use as reference), and a clearly visible return link and credit at your work/deviation.
Notes , shouts , and/or emails do not qualify...
You must also post a link (in the description/comments portion of your deviation) at your deviation/work for either the stock(s) used. DO NOT post to my dA front page [link] . This rule applies even if you take the project outside of Deviant Art (which you must have prior written permission for), or if you only use the deviation for reference...

Due to the mobile phone service DA is operating, I want you to understand that we do not want any of our resources you have used available on said service. We may revise this policy once we have a better understanding of any/all the changes in policy and license, but until that time you must make those deviations with 'Ceiteach' material(s) in it 'inactive'...

Only non-commercial permission : Use of these materials in a commercial fashion is not authorized without express written consent of the producer and possibly some of the models...
A "non-commercial" project is not just a project in which no profit is made {it is a project in which no money, or other gratuity changes hands}. Advertisements and other such projects which are indirectly commercial in nature do not count as noncommercial, so you will need to obtain direct 'legal' permission before you can use our deviations { past, present or future } in such indirectly commercial projects.

Commercial use is prohibited : You are explicitly prohibited from putting 'Ceiteach' material to commercial use without prior permission. Using a 'Ceiteach' item or items in a commercial project without expressed permission from the Ceiteach Producer[s]{and possibly the models as well} who produced the material is copyright infringement! Legal action will be taken at your cost...

If you would like to use any 'Ceiteach' resources, stock, textures and/or other material in a commercial project, you may negotiate with the Producer of that material directly to obtain their permission and a commercial use license. Use of our material does not always cost you monetarily, and battering is not uncommon with Ceiteach personnel...

A Producer holds control of the copyright of any stock {or any other work submitted} he/she made for 'Ceiteach', and so a Producer may decline your request for commercial use of his/her stock. The details of a commercial use license are decided by you and by the Producer and are not dictated by 'Ceiteach'. These details include the scope of use allowed and any fees required. As part of any agreement a Producer is free to request a fee in the form of a royalty, a product demo, explicit credit, or any fee that the Producer wishes. A Producer may also decline to take any fee, and may issue you a license without charge.

Several examples of uses considered to be commercial projects follow, but besides these there are many other uses considered to be commercial projects, so if you have any confusion about whether or not your project could be considered a commercial project please contact 'Ceiteach' and inquire about your case. Best to play it safe, than be sorry for all the problems caused later.
Below are the examples:

DA Prints and other such art prints, advertisements for commercial entities, web design for commercial entities, book covers and art in books, c.d. covers and art in c.d's, and also in art as part of a portfolio all qualify as commercial projects.

For any of these uses and for any other commercial use you will need to obtain the Producer's permission beforehand.

Use of deviations : Your use {in any form} of our deviations {stock, resources, textures, etc...} is not an acceptance {on our part, or the part of the models} of your viewpoints, art, actions, or thoughts. We {the producers, nor the models} can not, and will not be held accountable on how these deviations are used. We would prefer these deviations were not used in rude or hateful manner, but we also realize that we can not control what others may think of as offensive...
It should also be obvious that your use of our material does not mean you accept our viewpoints, or thoughts on any given subject.

Do not claim these as your own : No false claims. Only the 'Ceiteach' Producer that made a particular deviation item may claim to have created it, or have ownership of it. Do not use them as part of another 'set' for redistributing and do not "sell" or "trade" them.

Acceptance : You, as a user of any Ceiteach resources, and/or materials, accept any and all liability & responsibility that may arise from its use.
By downloading, storing, or using any stock or resources from Ceiteach you are agreeing to accept the following guideline rules of this license.

Exceptions : Have, and can be made. However they will be in express written form. Email , chat/IM, shouts, and/or notes are not express written consent...

Misinterpretations of the guidelines : If for whatever reason the guidelines here and the information at the deviation seem conflicting, or confusing, then note/contact us prior to any attempts to work on your project. If you are confused about or do not understand the terms here, we will do our best to explain them. However we do not provide a translation service, if English is not a primary language for you.

These are ours : To post, layout, and do with as we please. Do not say our deviations needs to be rotated or fixed. We are likely to tell you to rotate. It's a resource for Gawd sake, which is meant to be manipulated, edited, or somehow otherwise transformed. This means someone will take it into an editor (or some other such program) and do with it what they will.
Do not expect polished resources for free...

Abuse of these terms will not be tolerated : Abuse of these terms will not be ignored. All such activities will be dealt with {up to and including legal actions if need be}... Unfortunately these terms have been abused all ready, and we let the legal hounds loose on them... Should you suspect a possible infringement of any 'Ceiteach' material we ask that you please advise us privately... In fact if you suspect a possible infringement of any artists’ material we ask that you please advise them and the site moderators privately and considerately...

Model releases : Yes we have model releases and no we do not provide them to anyone {without one hell of a good provable legal reason}. We will pass on requests to the models; as long as they are just that. We will not pass on some lame come on, odd comments, requests for dates, offensive remarks, or cryptic writings...

These terms and conditions are subject to change : At any time, without notice, so we suggest you check this accounts journal (or more specifically this journal entry) on a regular basis. However we will attempt to make the updates to this journal 'major' edits, and note it in our journal occasionally.

Reserved rights : Ceiteach {and its producers} also reserves the right to revoke this License on any of the items they have produced. We can do this as we will, at any time, for whatever reason we see fit.
It is, after all, our work.

Notice ; We are not lawyers, nor are we experts at the written language. Thus there may be errors within these posted terms. We will happily correct errors pointed out to us, as long as they fall within the original concept of what these terms were intended for, if you do so in a polite and/or professional manner, and if you can provide good proof or precedence on the matter in question...
Lack of understanding due to a language or other barrier on your part will not stop us from taking the appropriate action against those that violate these terms...

These Copyright Notices, Terms, Rules, and/or guidelines supersedes any other found within the descriptions of submitted deviations.
